Human Rights Report 2011 on Indigenous Peoples in Bangladesh : Kapaeeng Foundation

EXECUTIVE SUMMARY
Despite strengthening solidarity and unity among indigenous peoples and civic groups of mainstream Bengali population with strong media support, the Indigenous Peoples in Bangladesh passed 2011 amidst numerous victims facing gross abuses of human rights without access to justice. The perpetrators, irrespective of state and non-state actors, enjoyed with full impunity. Land dispossession of the Indigenous Peoples and massive communal attack on them in order to occupy their land continues unabated. Constitutional recognition of Indigenous Peoples and implementation of CHT Accord of 1997 remain unfulfilled, due to continuous following of policy-neglect by the Government of Bangladesh.
 I. Introduction
It is encouraging that the National Human Rights Commission (NHRC) adopted strategic planning for the promotion and protection of the rights of the indigenous peoples. However, the NHRC still lacks institutional capacity due to lack of government support and strong democratic processes.
The Government mentioned in the Sixth Five Year Plan (FY2011-FY2015) that it would consider implementing the UN Declaration on the Rights of Indigenous Peoples 2007 and ratify the ILO Convention 1969. The Sixth Five Year Plan also mentioned that an appropriate land policy will be formulated which can deal with land disputes involving indigenous peoples.
Indigenous Peoples raised their voice for adequate budgetary allocation to eliminate disparity and discrimination between them and the mainstream Bengali people. It is observed that about 2 per cent of the country’s population is indigenous peoples, but the allocation for them is below 0.5 per cent of the total budgetary allocation.
 II. Identity of Indigenous Peoples
Ignoring strong demands of the indigenous peoples and civic groups of mainstream population of the country, the present Awami League-led government has denied the constitutional recognition of fundamental rights of indigenous peoples in the 15th amendment of the Constitution in 2011. Despite very specific demands, the government did not ensure constitutional recognition of CHT Accord of 1997 and acts and laws enacted as per the Accord, in that new constitutional reform. Parliamentary Caucus on Indigenous Peoples proposed to enact a “Bangladesh Indigenous Peoples’ Rights Act” and to set up a “National Commission on Indigenous Peoples” under an act to ensure the rights of indigenous communities on their ancestral lands. According to the Caucus, the existing laws are not adequate to ensure the rights of the indigenous peoples.
 III. Land Rights and Land Dispossession
The major problem for all adivasis is land grabbing by influential people from the mainstream population. There are no adequate policies to protect the land of indigenous peoples. The traditional land rights of indigenous peoples are being ignored. The incidents of forcible land-grabbing by Bengali land grabbers and eviction of indigenous peoples from their ancestral land were also seen as common scenario in 2011.
In the year 2011 at least 111 houses of indigenous Jumma villagers were completely burnt to ashes in the CHT while 12 houses (6 houses each in the CHT and the plain lands) were looted and ransacked due to land-related communal conflicts. In addition, at least 146 Jumma families in the CHT were attacked by Bengali settlers while 19 indigenous families in the plain land were attacked. Besides, 21 indigenous persons including 1 from plain lands were assaulted while 3 indigenous persons (2 from CHT and 1 from plain lands) were brutally killed. On the other hand, at least 7,118 acre of land belonging to indigenous Jumma people were grabbed by Bengali settlers in the CHT in 2011. Several attempts have also been made to occupy Jumma’s land by the Bengali settlers.
 
 IV. Main Human Rights Issues
The failure to thoroughly investigate human rights violations by Bengali settlers with the support of the law enforcement agencies in the CHT and by influential land grabbers and criminals with the support of local administration including police in the plain lands remained a matter of serious concern. The perpetrators, irrespective of state and non-state actors, acted with full impunity.
In 2011, 7 indigenous people, 3 from CHT and 4 from plain lands, were killed while 13 persons were arrested or detained. In addition, 30 indigenous persons, 29 victims are from CHT out of them, were tortured, harassed and threatened. At least 8 massive communal attacks were made upon Indigenous Peoples across the country. Of them, 4 attacks were made in the CHT. All the the communal attack in the CHT were committed by Bengali settlers and in these attacks security forces played either a passive role or collaborative role. At least 3 indigenous persons were killed in these communal attacks while 70 were injured. Besides, 137 houses of Indigenous Peoples were completely burnt to ashes while 47 houses were looted or ransacked.
Religious persecution on Indigenous Peoples also continued, particularly in the CHT.  This includes destruction of Buddhist temple with the aim to occupy temple’s land, harassment of Buddhist monks, destruction of Buddha statues, prevention to construction and repairing of temple etc

.V. Women’s Rights
The biggest concern in rape and other violence against indigenous women is the lack of access to justice and absolute impunity that perpetrators enjoy. In 2011, 5 indigenous women, of them 3 from the CHT and 2 from the plain lands, were killed after rape while 11 indigenous women were raped. Except 1 woman from the plain lands, the rest of the raped women were from the CHT region. In addition, attempts to rape were made on 8 indigenous women including 1 from the plain lands while 5 women (4 from the CHT and 1 from the plain lands) were abducted. Almost all violence against indigenous Jumma women in the CHT have allegedly been committed by Bengali settlers. Only one incident of attempted rape was reported to have been allegedly committed by a security personnel. 
 VI. Education and Children
Deprivation of access to quality education is a major factor contributing to social marginalization, poverty and dispossession of Indigenous Peoples. With regard to the admission quota for indigenous students, there is no coherent policy and the entire issue is often embroiled in bureaucratic interventions. In some cases, it is totally dependent on the discretion of the authority of the concerned educational institutions. In regard to quota in government jobs, the recruitments in the last six BCS examinations (24th-29th) show a diminutive representation of indigenous community’s candidates. Studies show that merely 1%-2% of tribal quotas were fulfilled since the policy was adopted and unfortunately such vacant seats till the 27th BCS were filled by non-tribal candidates.
 VII. Present State of Implementation of the CHT Accord
This year marks the passing of 14 years of signing of the CHT Accord. In the meantime, the present Awami League-led grand alliance which signed the Accord has already consumed 3 years of its tenure. But except for reconstitution of some committees and appointment to the some posts, the government has not taken any effective measures towards implementation of the Accord. Despite making it a priority commitment in the election manifesto and strong demands from the Jumma peoples and the civic society of the country, the government has not come up with a ‘Road Map’ with a time-frame to implement the 1997 CHT Accord. Hence, dissatisfaction and grievance has been mounting among the Jumma peoples and permanent Bengali residents in CHT over the years.
 VIII. Recommendations
(1)   To end all intimidation and harassment of Indigenous Peoples and to prosecute all those responsible for attacks and intimidation against Indigenous Peoples.
(2)   To take all measures to fulfill Awami League’s election promises by fully implementing the CHT Accord with a declared time-frame for a road map and providing a forum for solving land disputes of Indigenous Peoples in CHT and plain lands.
(3)   To implement ILO Convention No. 107 and ratify ILO Convention No. 169 concerning Indigenous and Tribal Peoples and relevant to the situation in Bangladesh.
(4)   To recognize, more categorically, the collective and individual rights of Indigenous Peoples over land and natural resources, in accordance with international human rights standards and in congruence with their customs and traditions.
(5)   To stop the systematic and forcible displacement of Indigenous Peoples from their ancestral lands and to develop legal mechanisms to save the illegal land dispossessions of Indigenous Peoples.
(6)   To form a separate land commission for plain land Indigenous Peoples for restoration of dispossessed land.
(7)   To stop communal violence and physical abuse against indigenous women and to conduct judicial inquiries into the communal violence and abuses against indigenous women.
(8)   To implement 5% quota in government jobs and education institutes for Indigenous Peoples.
(9)   To allocate adequate budget for Indigenous Peoples and to ensure full and effective participation of Indigenous Peoples in major decision-making processes in all development programmes.
(10)           Amendment of the Constitution-
a)      To incorporate the CHTRC Act 1998, and Rangamati, Khagrachari and Bandarban HDC Acts of 1998 (Amendment), which were enacted in congruence with the CHT Accord signed on 2 December 1997, in the First Schedule of the Constitution as ‘existing laws’;
b)      To replace ‘tribes, small nationalities, ethnic groups, and communities’ with ‘Indigenous Peoples’ in ‘Article 23A’ of the 15th Amendment to the Constitution;
c)      To enshrine the list of more than 54 different indigenous ethnic groups by adding a new schedule in the Constitution, and ensuring constitutional recognition of the Indigenous Peoples;
d)     To remove the phrase - ‘…people of Bangladesh shall be known as Bengali as a nation and…’ from Article 6 of the 15th  Amendment to the Constitution;
(11)           The NHRC should investigate human rights violations against Indigenous Peoples.

দেশের গণমাধ্যমের জোরালো সমর্থনসহ আদিবাসী জনগণের সাথে মূলধারার সুশীল সমাজের মধ্যে শক্তিশালী ঐক্য-সংহতি গড়ে উঠলেও বাংলাদেশের আদিবাসী জনগণ ২০১১ সাল অতিবাহিত করেছে ব্যাপক মানবাধিকার লঙ্ঘনের শিকারের মধ্য দিয়ে; যেগুলোর তারা কোন সুবিচার পায়নি রাষ্ট্রের সাথে যুক্ত বা রাষ্ট্রের সাথে যুক্ত নয় এমন সকল মানবাধিকার লঙ্ঘনকারী নির্বিশেষে বিচারের মুখোমুখী হয়নি আদিবাসীদের ভূমি হারানো আদিবাসীদের ভূমি জবরদখলের উদ্দেশ্যে সাম্প্রদায়িক হামলা পূর্বের মতো অব্যাহতভাবে চলছে বাংলাদেশ সরকার কর্তৃক আদিবাসী জনগণকে প্রান্তিকীকরণের অব্যাহত রাষ্ট্রীয় নীতির কারণে, আদিবাসীদের সাংবিধানিক ¯^xK…wZ ১৯৯৭ সালের পার্বত্য চট্টগ্রাম চুক্তির বাস্তবায়ন এখনো অর্জিত হতে পারেনি
ভূমিকা
এটি খুবই উৎসাহব্যঞ্জক যে, জাতীয় মানবাধিকার কমিশন আদিবাসীদের উন্নয়ন এবং সুরক্ষার জন্য কৌশলগত পরিকল্পনা গ্রহণ করেছে কিন্তু সরকারের অসহযোগিতা এবং অগণতান্ত্রিক প্রক্রিয়ার কারণে জাতীয় মানবাধিকার কমিশনের প্রাতিষ্ঠানিক সক্ষমতা এখনো গড়ে উঠতে পারেনি
ষষ্ঠ পঞ্চবার্ষিকী পরিকল্পনায় (২০১১-২০১৫) উল্লেখ করা হয়েছে যে, সরকার আদিবাসী জাতিগোষ্ঠীর অধিকার বিষয়ক জাতিসংঘ ঘোষণাপত্র ২০০৭ বাস্তবায়ন এবং আইএলও কনভেনশন ১৬৯ Aby¯^v¶i করার বিষয়টি বিবেচনা করবে ষষ্ঠ পঞ্চবার্ষিকী পরিকল্পনায় আরো উল্লেখ করা হয়েছে যে, একটি যথাযথ ভূমি নীতি প্রণয়ন করা হবে যেখানে আদিবাসীদের ভূমি বিরোধগুলো নিষ্পত্তির বিধান করা হবে
আদিবাসী জাতিগোষ্ঠী মূলধারা জনগণের মধ্যকার পার্থক্য বৈষম্য নির্মূলীকরণের জন্য পর্যাপ্ত বাজেট বরাদ্দ দাবী তুলেছেন আদিবাসী জনগণ এটি লক্ষ্যণীয় যে মোট জনসংখ্যার শতাংশ আদিবাসী জনগণ হলেও মোট বরাদ্দকৃত অর্থের মাত্র ০.৫ শতাংশ তাদের জন্য বাজেট বরাদ্দ করা হয়
আদিবাসীদের পরিচিতি
আদিবাসী জনগণ মূলধারার সুশীল সমাজের প্রবল দাবীকে উপেক্ষা করে আওয়ামী লীগের নেতৃত্বাধীন বর্তমান মহাজোট সরকার ২০১১ সালে সংবিধানের পঞ্চদশ সংশোধনীতে আদিবাসীদের মৌলিক অধিকারের সাংবিধানিক ¯^xK…wZ‡K A¯^xKvi করেছে সুনির্দিষ্ট দাবী সত্ত্বেও সরকার পার্বত্য চট্টগ্রাম চুক্তি ১৯৯৭ এবং চুক্তি অনুসারে প্রণীত আইনগুলোর সাংবিধানিক গ্যারান্টি নিশ্চিত করা হয়নি আদিবাসী বিষয়ক সংসদীয় ককাস আদিবাসী জনগণের ভূমি অধিকারসহ আদিবাসীদের মৌলিক অধিকার নিশ্চিতকরণের জন্য বাংলাদেশ আদিবাসী অধিকার আইন প্রণয়ন এবং আদিবাসী বিষয়ক জাতীয় কমিশন গঠন করার প্রস্তাব করেছে ককাসের মতে, বর্তমানে দেশে বিদ্যমান আইনগুলো আদিবাসীদের অধিকার রক্ষার্থে যথেষ্ট নয়
ভূমি অধিকার এবং ভূমি হারানো
আদিবাসীদের জন্য প্রধান সমস্যা হল মূলধারার জনগোষ্ঠীর প্রভাবশালী লোকদের দ্বারা ভূমি জবরদখল বাংলাদেশে আদিবাসীদের ভূমি রক্ষার্থে কোন পর্যাপ্ত নীতিমালা নেই আদিবাসীদের প্রথাগত ভুমি অধিকার নানাভাবে উপেক্ষিত হচ্ছে প্রভাবশালী ভূমিদস্যু কর্তৃক জোরপূর্বক ভূমি দখল এবং আদিবাসীদের চিরায়ত ভূমি থেকে উচ্ছেদ সাধন অন্যান্য বছরের মতো ২০১১ সালেও সাধারণ একটি বৈশিষ্ট্য ছিল
২০১১ সালে ভূমি-সংক্রান্ত সামপ্রদায়িক সংঘাতের কারণে পার্বত্য চট্টগ্রামে অন্ততপক্ষে ১১১ ঘরবাড়ি সম্পূর্ণভাবে জ্বালিয়ে দেয়া হয়েছে অপরদিকে ১২টি ঘরবাড়ি (পার্বত্য চট্টগ্রাম সমতল অঞ্চলে ৬টি করে) লুটপাট এবং তছনছ করা হয়েছে উপরন্তু পার্বত্য চট্টগ্রামে কমপক্ষে ১৪৬ জুম্ম পরিবার এবং সমতল অঞ্চলে কমপক্ষে ১৯টি আদিবাসী পরিবার আক্রমনের শিকার হয়েছে এছাড়া সমতল অঞ্চলের জনসহ মোট ২১ জন আদিবাসীর উপর আক্রমণ করা হয়েছে পার্বত্য চট্টগ্রামে জন সমতল অঞ্চলে জন আদিবাসী নির্মমভাবে হত্যার শিকার হয়েছে অন্যদিকে ২০১১ সালে কমপক্ষে ,১১৮ একর আদিবাসীদের ভূমি সেটেলার বাঙালী কর্তৃক বেদখল হয়েছে অনেক জায়গায় সেটেলার বাঙালী কর্তৃক আদিবাসীদের ভূমি দখলের চেষ্টা করা হয়েছে
মৌলিক মানবাধিকার
পার্বত্য চট্টগ্রামে আইন প্রয়োগকারী সংস্থার সহযোগিতায় এবং সমতলে স্থানীয় প্রশাসনসহ পুলিশের সহযোগিতায় প্রভাবশালী ভূমিদস্যু এবং অপরাধীদের দ্বারা মানবাধিকার লঙ্ঘনের ঘটনা পুঙ্খানুপুঙ্খ তদন্তে ব্যর্থ হওয়া অত্যন্ত উদ্বেগের বিষয়
২০১১ সালে জন আদিবাসী ব্যক্তিকে (যাদের মধ্যে জন পার্বত্য চট্টগ্রাম এবং জন সমতল অঞ্চল থেকে) হত্যা করা হয়েছে, অপরদিকে ১৩ জন আদিবাসীকে গ্রেফতার বা অন্তরীণ করা হয়েছে উপরন্তু সমতল অঞ্চলের জনসহ মোট ৩০ জন আদিবাসীকে নির্যাতন, হয়রানি এবং হুমকি প্রদান করা হয়েছে সারাদেশে আদিবাসীর উপর কমপক্ষে ৮টি সংঘবদ্ধ সাম্প্রদায়িক হামলা করা হয়েছে তাদের মধ্যে ৪টি পার্বত্য চট্টগ্রামে ৪টি সমতল অঞ্চলে সংঘটিত হয়েছে পার্বত্য চট্টগ্রামের সব সাম্প্রদায়িক হামলা সেটেলার বাঙালী কর্তৃক সংঘটিত হয়েছে এবং এসব হামলায় নিরাপত্তা বাহিনী হয় নীরব ভূমিকা নতুবা সহযোগী ভূমিকা পালন করেছে এসব সংঘবদ্ধ সামপ্রদায়িক হামলায় কমপক্ষে জন আদিবাসী ব্যক্তিকে হত্যা করা হয়েছে; পক্ষান্তরে ৭০ জনের মতো আদিবাসীকে আহত করা হয়েছে তাছাড়া আদিবাসীদের ১৩৭ টি ঘরবাড়ি সম্পূর্ণভাবে জ্বালিয়ে দেয়া হয়েছে এবং ৪৭টি ঘর লুঠপাট বা ভাংচুর করা হয়েছে
আদিবাসীদের উপর বিশেষত পার্বত্য চট্টগ্রামে ধর্মীয় পরিহানি অব্যাহত রয়েছে তন্মধ্যে মন্দিরের ভূমি দখলের জন্যে বৌদ্ধ মন্দির ভাংচুর, ভিক্ষুদের হয়রানি করা, মন্দির নির্মাণে বা মেরামত কাজে বাধা দান করা ইত্যাদি অন্তর্ভুক্ত রয়েছে
নারী অধিকার
নারী অধিকারের ক্ষেত্রে সবচেয়ে উদ্বেগের বিষয় হলো আদিবাসী নারীর উপর ধর্ষণসহ তাদের বিরুদ্ধে মানববতা বিরোধী সহিংসতা এবং এতে অপরাধীকে বিচারের আওতায় না আনা ২০১১ সালে জন আদিবাসী (যার মধ্যে জন পার্বত্য চট্টগ্রামের এবং জন সমতলের) নারীকে ধর্ষনের পর হত্যা করা হয়েছে এবং ১১ জন নারীকে ধর্ষণ করা হয়েছে ধর্ষণের শিকার নারীদের মধ্যে সমতলের জন আদিবাসী নারী ছাড়া বাকী সব নারী ছিল পার্বত্য চট্টগ্রামের অধিকন্তু সমতলের ১জন নারীসহ জন নারীকে ধর্ষনের চেষ্টা করা হয়েছে এবং জন (৪ জন পার্বত্য চট্টগ্রাম থেকে এবং জন সমতল থেকে) নারীকে অপহরণ করা হয়েছে পার্বত্য চট্টগ্রামে সংঘটিত নারীর বিরুদ্ধে সহিংসতার ঘটনাবলী অধিকাংশই ঘটানো হয়েছে সেটেলার বাঙালী কর্তৃক শুধুমাত্র একজন আদিবাসী নারীকে নিরাপত্তা বাহিনী একজন সদস্য কর্তৃক ধর্ষণের চেষ্টার অভিযোগ পাওয়া গেছে
শিক্ষা এবং শিশু অধিকার
আদিবাসীদের সামাজিক প্রান্তিকতা, দারিদ্রতা এবং উচ্ছেদ হওয়ার পেছনে প্রধান কারণগুলোর অন্যতম হলো গুণগত শিক্ষার অধিকার থেকে বঞ্চিত হওয়া আদিবাসী ছাত্রছাত্রীদের জন্য সংরক্ষিত কোটার ক্ষেত্রে এখনো সঙ্গতিপূর্ণ নীতিমালার অভাব রয়েছে এবং আমলাতান্ত্রিক হস্তক্ষেপের মধ্যে বিদ্যমান রয়েছে কিছু কিছু ক্ষেত্রে এটি সম্পূর্ণভাবে সংশ্লিষ্ট শিক্ষা প্রতিষ্ঠানের কর্তৃপক্ষের মর্জির উপর নির্ভরশীল সরকারী চাকুরীর ক্ষেত্রে বিগত ৬টি ব্যাচের বিসিএস পরীক্ষায় (২৪তম-২৯তম) সংরক্ষিত কোটা থেকে কমসংখ্যক আদিবাসী প্রার্থী লক্ষ্য করা যায় গবেষণায় দেখা যায়, আদিবাসীদের জন্য চাকুরী কোটা সংরক্ষণের পর থেকে বিসিএসের ২৭তম ব্যাচ পর্যন্ত বড়জোর ১% থেকে ২% কোটা পূরণ হয়েছে এবং অবশিষ্ট কোটা অ-আদিবাসী প্রার্থী দ্বারা পূরণ করা হয়েছে
পার্বত্য চট্টগ্রাম চুক্তির বাস্তবায়নের বর্তমান অবস্থা
এই বছরে পার্বত্য চুক্তির ১৪ বছর পূর্ণ হতে চলেছে একই সাথে আওয়ামী লীগ নেতৃত্বাধীন বর্তমান মহাজোট সরকার, যে দল ১৯৯৭ সালে পার্বত্য চুক্তি ¯^v¶‡ii পর পুনরায় ক্ষমতায় এসেছে, সেই সরকারের মেয়াদ ইতিমধ্যে বছর অতিক্রান্ত হয়েছে কতিপয় কমিটি পুনর্গঠন করা এবং কতিপয় পদে নিয়োগ দেয়া ছাড়া পার্বত্য চট্টগ্রাম চুক্তি বাস্তবায়নের ক্ষেত্রে সরকার কোন কার্যকর পদক্ষেপ গ্রহণ করেনি নির্বাচনী ইশতেহারে অঙ্গীকার প্রদান এবং আদিবাসী দেশের সর্বস্তরের নাগরিক সমাজের পক্ষ থেকে জোরালো দাবি থাকলেও সরকার পার্বত্য চট্টগ্রাম চুক্তি বাস্তবায়নের জন্য সুনির্দিষ্ট সময়সীমা ভিত্তিক কর্মপরিকল্পনা (রোডম্যাপ) ঘোষণা করেনি ফলশ্রুতিতে পার্বত্য চট্টগ্রামের স্থায়ী বাঙালী অধিবাসী এবং জুম্ম জনগণের মধ্যে চরম অসন্তোষ এবং ক্ষোভ জন্ম দিয়েছে
সুপারিশমালা
1.       আদিবাসীদের বিরুদ্ধে সকল ধরনের নিপীড়ন এবং হয়রানি বন্ধ করা এবং আদিবাসীদের উপর হামলা নিপীড়নের সাথে জড়িতদের বিচারের আওতায় নিয়ে আসা
2.      সময়সীমা ভিত্তিক রোডম্যাপ ঘোষণাসহ পার্বত্য চট্টগ্রাম চুক্তি সম্পূর্ণভাবে বাস্তবায়ন এবং পার্বত্য চট্টগ্রামের আদিবাসী সমতলের আদিবাসীদের ভূমি সমস্যা সমাধানের জন্য কমিশন কার্যকরকরণের মধ্য দিয়ে আওয়ামী লীগের ঘোষিত নির্বাচনী ইশতেহার পূরিপূরণ করা
3.      আদিবাসী ট্রাইবাল জাতিগোষ্ঠী বিষয়ক আইএলও কনভেনশন নং ১০৭ বাস্তবায়ন করা এবং আইএলও কনভেনশন নং ১৬৯ Aby¯^v¶i করা
4.      আন্তর্জাতিক মানবাধিকার মানদন্ড এবং আদিবাসীদের প্রথা রীতিনীতির সাথে সংগতি রেখে ভূমি এবং প্রাকৃতিক সম্পদের উপর আদিবাসীদের সমষ্টিগত এবং ব্যক্তিগত অধিকার ¯^xK…wZ প্রদান করা
5.      আদিবাসীদেরকে তাদের চিরায়ত ভূমি থেকে ধারাবাহিক জোরপূর্বক উচ্ছেদ বন্ধ করা এবং আদিবাসীদের ভূমি হারানো বন্ধ করার জন্য আইনী ব্যবস্থা গড়ে তোলা

FACT FINDING REPORT: Death of a Businessman in Jail Custody Due to Negligence of Treatment: Family Member Alleges of Torture for Bribe

Introduction:


In December 2011, Advocate Sahanur Islam (Saikot), Founding Secretary General of JusticeMakrs Bangladesh, Dhaka and also Country Observer of Global human rights Defence (GHRD), Netherlands along with three members went to the spot to conduct a fact finding investigation mission on the incident of death of a businessman due to negligence of treatment: family member alleges of torture for bribe on the December 22, 2011-– taking victim’s family, eyewitness, perpetrators and concerned authorities statements. We are to date the only human rights organization to conduct a first hand investigation into the incident of death due to torture for bribe and negligence of treatment.

The events reported above were just one of the many cases of gross human rights violation in Bangladesh which cannot be tolerated. The right to life is an undeniable human right. The police torture, negligence of adequate treatment, keep the deteriorated conditioned patient in bar fatter and also taking bribe are a clear violation of universal human rights where Bangladesh’s commitments under international human rights treaties.

During the investigation, some civil dressed people (it is assumed by the fact finding team that they were security personnel dressed as civilians) were continuously following the investigation team.  When the fact finding team contacted the accused policeman Assistant Sub Inspector Rabiul Islam about his statement regarding taking bribe through cell phone, he handed over the phone to Sub Inspector Rafikul Islam and Mr. Islam threatened to Mr. Shahanur Islam, head of the fact finding team stating proudly that we are entitled to take money from accused person for our cost of fuel, tea and cigarette. So, you can not do anything against our activities, rather you will face trouble to  further continue your activities.” He also told that “We want to see your power, show us your power, if you have any power to stop our activities, you can exercise it, otherwise go to hell”.

JusticeMakers Bangladesh demands that a full and impartial investigation into the misconduct of relevant official is required and that those responsible are punished.

A Businessman Died in Jail Custody Due to Negligence of Proper Treatment: Family Member Alleges of Torture for Bribe

The news headlines read: “Under Trial Prisoner died at Naogaon” published on the daily Karotoa on December 24, 2011. As a result, a high level fact-finding mission was conducted by a team of JusticeMakers Bangladesh led by Advocate Shahanur Islam (Saikot), Founding Secretary General of JusticeMakers Bangladesh and also Country Observer of Global Human Rights Defence (GHRD) from December 25-29, 2011. During the mission, the fact finding team talked with the victim’s family members, other eyewitnesses and concerned authorities as well as collecting evidence of the incident.  This report documents the findings of the Investigation:

Case Summery: (based on testimony of victims family members & eyewitness):

A team of policemen led by Touhidul Alam, Sub Inspector of Badalgachhi police station under Naogaon district arrested Mr. Abdul Bari Dulu on December 20, 2011 around at 11.00 a. m from the Khadail bazaar under the Mithapur Union Parishad of above mentioned police station and district according to the warrant of arrest connecting the case file against him being number: Shahabag Police Station, D.M.P case Number: 24(12)/2011,  CR case number: 362/ 2011, Chief Metropolitan Magistrate Court, Dhaka;  CR Case Number: 572/2011, Chief Metropolitan Magistrate Court, Dhaka and CR Case Number: 32/2011, Metropolitan Magistrate Court, Dhaka, while he was waiting to meet with his wife to go his relative home. Then he was taken to the said police station. As soon as his wife informed about his arrest, she went to the police station and met with him when he was quite ok. On the following day, his wife informed by one police official through mobile phone that the victim was seriously ill.

Being informed about his illness, the victim’s wife along with her younger sister went to the police station on December 21 morning and saw the victim lying down on the floor of the police station custody without treatment. Then, she was called to go one corner of the police station by the Sub Inspector (SI) Karibul Hasan, while she requested the police official for the treatment of the victim. At that stage she was demanded bribe by SI Karibul Hasan for his treatment. But she failed to pay as she was no enough money at that time.

Meanwhile, the sister of law of the victim asked one unidentified police official whether the victim was tortured or not. The policeman replied with smiling that he was not tortured, but If the victim were not ill, he would beaten hanging the tree.

Later, the victim was taken to the out door of Badalgachhi Upazila Health Complex morning on 21 December around at 11.00 a. m and the concerned doctor prescribed him some medicine.

Thereafter, the victim was taken to the custody of Chief Judicial Magistrate Court, Naogaon. Meanwhile, the victim wife and his sister in law reached the court custody and trying to talk with the victim. But the court police denied to talk with him and demanded to pay some bribe for allowing to talk with him. Paying some small amount of bribe to the court police, the victim’s wife and sister in law met with the victim, where they saw that the victim was laid down on a bench as he was unable to sitting down or standing up and trying to sitting down on the bench seeing them. Then, the victims wife and sister in law help him to sitting down on the bench. At this stage the victim’s wife asked him in presence of court police, whether he was tortured or not? And the victim replied her requesting not to ask this kind of question further. In this moment they saw the mark spot like electric shock on both sides of his ribs. Please See the video Statement:


Then the victim was appeared before the Senior Judicial Magistrate Court, Naogaon and the learned magistrate issue an order to send the victim to the jail. The learned magistrate also asked the concerned authority to take immediate action to his proper treatment admitting him at the hospital.

Thereafter, on afternoon the victim was sent to the Naogaon jail and the jail authority admitted him at prison hospital on the same day. But in midnight physical condition of the victim was deteriorated and the pharmacist of the jail hospital referred him at Naogaon Sodar Hospital.

On the following day December 22, 2011 morning, the victim was admitted at the Naogaon Sodar Hospital with police escort. At noon of the same day, being informed of deteriorate condition of the victim, the victim’s wife went the see him at hospital. But the police did not allow her to see him primarily. Finally, she was allowed to nursing her husband after requested repeatedly with crying, where she saw that the victim was kept in bar fetters (danda beri ) and hand cuff fastened with bed  by thick rope. She also saw that the victim suffered so much bad situation and the victim left stool and urine on his cloth and doing ardor for remove the bar fetter. Seeing fervidity of the victim, she requested the jail police to remove his bar fetter, but they denied and asked her to go to the jail for getting permission of removing bar fetter. Gradually, the victims condition was more deteriorating and on evening of the same day he was died around 7.15 PM. Then his far better and hand cuff was remove after half an hour letter of his death. Thereafter, an inquest report of the dead body was prepared by a police official, signed by an Executive Magistrate on the same evening. Finally, his dead body was handed over the relatives of the victim.

Background Information:

The victim Abdul Bari Dulu was implicated in four cases at Dhaka city in Bangladesh where he was doing a small business. Then he came to his permanent house leaving Dhaka city. Early of the year 2011, order of the warrant of arrest and attachment was issued against him by the Chief Metropolitan Magistrate Court, Dhaka. The Badalgachhi police station was responsible for execute this order of warrant of arrest as the local police station. But unfortunately the concerned police station denied to execute the order giving illegal facility to the victim taking a huge amount of bribe regularly.

Finally, Assistant Sub Inspector, Rabiul Islam and Constable Abdul Razzak went to the house of the victim to execute the order of Warrant of Arrest and attachment on December 16, 2011 and demanded  BDT 20, 000/= ( Twenty Thousand taka) to the wife of the victim as bribe for commitment of not to attach the goods of his house. He also demeaned BDT 50, 000/= (Fifty Thousand) as bribe committing not to arrest or attach his good for next two months. The victim’s wife agreed to give him BDT: 10,000 (Ten Thousand) by December 18, 2011 and BDT: 20,000/= (twenty Thousand) money by December 28, 2011. Then, the policeman returned without arrest or attached the goods. Wwife of the victim gave BDT: 10,000/= (ten Thousand) to ASI Rabiul Islam on said date through Abdul Jalil, member of Mithapur union Parishad under Badalgachhi police station of Naogaon district.  Observations of Fact-finding Team:

Report published on news paper, statement received from the victim family members of the victim and eyewitness and collected document from the different public office, it is clear that the death of Mr. Abdul Bari is result of torture at police custody as well as negligence of provide adequate treatment due to unable to pay illegal money as bribe which is violation of our fundamental, legal and human rights. The findings of the fact finding mission are followings:

*      Mrs. Yiasmin Akhter Bulbuli, Sister in law of the victim strongly apprehended that his brother in was given electric shock at police station as they was unable to pay more bribe to the police official according to their demand previously. She also mentioned that the victim requested not to ask question about torturing being afraid of the police as they were always in present. If he told about torture, the policeman might be not gave him treatment or create more trouble.

*      The police official denied to arrest the victim timely taking huge amount of bribe from the victim and his family.

*      In spite of being healthy and vigorous during arrest, mysteriously the victim was seriously ill like dead at the police station by one night.

*      In spite of being seriously ill in midnight at police station, the victim was not admitted the hospital for adequate treatment.

*      The police official at police station demanded bribe for treatment of the victim as well as the court police also demanded and taken bribe to allow his wife to talk at court premises.

*      In spite of issuing direction to provide proper treatment learned court, the jail authority failed to provide the victim adequate treatment. The victim’s physical condition was deteriorating in midnight, but the jail authority did not take step to admit him Sador hospital for his better treatment.

*      Though the victim was admitted in Hospital on following day morning, he was kept in bar fetters (danda beri ) and hand cuff fastened with bed  by thick rope.

*      Though the victim condition was being deteriorated, his family member was not allowed to nursing him in hospital.

*      Though the police official at Badalgachhi police station admitted that they took some money from the victim and his family illegally, but they proudly mentioned that they were entitled to take such kind of money from the accused as their cost of fuel, tea and cigarette.

*      As all member of Badalgachi police station from Officer in Charge to constable of Naogaon were involve with taking illegal money as bribe, the Officer in Charge (OC) and also the Superienten of Police (SP) of naogaon district did not take any initiative to take step against the allegation of taking bribe made by the victims family.

*      After the death of the victim, though the accused police man ASI Rabiul Islam assured Mr. Abdul Jalil, Member of Mithapur Union Parishad that he would back the money to the victim family by December 25, 2011 evening, he did not back it. When Mr. Jalil asked the accused policeman about his promises through mobile phone in presence of fact finding team, he told that already he backed it to the Chairman of Mithapur Union parishad. But Al Haz Mohiuddin alamgir, Chairman of the said union parishad told the fact finding team that he has no contact with the policeman about this matter of money. Please See the video statement:  



*      The inquet report of the deadbody was prepared by a poice official, signed by an Executive Magistrate on the same evening and the inquest Report claimed that there was no sign of injury on the body of the deceased. The inquest report attempted to establish that victim died naturally without torture or negligence of treatment.  The civil, prison, hospital and police administration jointly suppressed the facts regarding the custodial torture and negligence of adequate treatment

*      Finally, the environment of Naogaon jail is so unhygienic. There is remaining accommodation problem, sanitation problem, lack adequate food & water as well as lack of proper treatment. Even there is no doctor in Jail hospital.

Legal FrameWork:

The practice of torture is considered one of the most serious human rights crimes and as such it is part of jus cogens. No person, regardless whether he is a criminal or not, should be subjected to torture by law enforcement officers in any circumstances.

The Constitution of Bangladesh Article 35 (5) prohibits torture. Bangladesh is also a state party to the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT), since October 1998. However, by refusing to implement Article 14 of CAT, an integral part of the convention which guarantees victims the legally-enforceable right of redress, rehabilitation and compensation, the government has effectively negated its commitment to the entire treaty.

In sum, despite joining
CAT and having a constitutional provision prohibiting torture, the Government of Bangladesh has taken no steps to criminalise torture, passed no treaty enabling legislation or amended domestic laws to give access to remedies, rehabilitation or compensation for victims. Finally, individuals who have suffered torture only have recourse to national remedies.

Recommendations:

JusticeMakers Bangladesh urges the government of Bangladesh to:

  1. To institute an independent commission headed by a High Court Judge with a view to enquire into the matter to ascertain the cause of death of Mr. Abdul Bari Dulu, taking illegal money as bribe by police both in police station and court as well as kept him in bar fetter at hospital bed  and publish the report at the earliest;

  1. To ensure exemplary punishment of the perpetrators who were directly and indirectly involved in this gross violation of human rights;

  1. To provide adequate financial compensation to the victim’s family; as well as  guarantee the physical and psychological integrity of victims family

  1. To ratify the Optional protocol to the Convention Against torture and other inhuman, cruel or degrading punishment or treatment (OPCAT);

  1. To ensure the adequate accommodation, food, water, sanitation and proper treatment facility in jail custody;

  1. To reform the jail code and prison centre for better service in jail custody;

  1. To ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards;

  1. To provide human rights education and training to the concerned personnel related to the police station, court, hospital and prison centre;

  1. To remove reservation from Art.14 of Convention against Torture.

§          To publish a weekly "Law Corner" in a popular magazine, with cartoons to simplify legal problems and to respond to inquiries about legal problems for those who need legal advice and cannot receive it;
§          To conduct lobbying, campaign and advocacy activity to protect and promote human rights in national and international level;
§          To conduct research on legal and human rights aspect as well as conduct fact finding and issue urgent appeal/action regarding violation of human rights;
  • To build up institution as well as human rights defender in community level.

গতকাল ০৩ জানুয়ারী ২০১২ ইং তারিখে বিডি নিউজ ২৪ ওয়েবসাইটে প্রকাশিত সাবাদিক পেটানোর অভিযোগ কামাল মজুমদারের বিরুদ্ধে শীর্ষক সংবাদ থেকে জানা যায় যে, ছাত্র ভর্তির নামে অতিরিক্ত ফি আদায়ের খবর পেয়ে বেসরকারী টিভি চ্যানেল আরটিভির সাংবাদিক অপর্না সিংহ গতকাল সকালে রাজধানীর মিরপুরে অবস্থিত মনিপুর স্কুলে যান। সাংবাদিক অপর্না সিংহ অতিরিক্ত ফি আদায়ের আদায়ের বিষয়ে উক্ত স্কুলের ম্যানেজিং বডির চেয়ারম্যান ও সংসদ সদস্য কামাল আহমেদ মজুমদারের দৃস্টি আকর্ষন করলে তিনি সাংবাদিক অপর্না সিংহকে ধাক্কা দেন। এসময় তিনি উক্ত সাংবাদিককে অকথ্য ভাষায় গালি গালাজ করেন ও শারীরিকভাবে নির্যাতন করে বলে জানা যায়। ঘটনাটি মানবাধিকারের লংঘন ও যথাযথ তদন্তপূর্বক প্রয়োজনীয় ব্যবস্থা গ্রহন করা আবশ্যক বলে জাষ্টিসমেকার্স বাংলাদেশ মনে করে
