Human rights lawyer and journalist in Bangladesh once again received threats for life along with his family

Advocate Shahanur Islam @ Saikot, founding secretary general of “JusticeMakers Bangladesh”, legal & human rights editor of the monthly Bengali magazine “Doyel” as well as member of the “Bangladesh Bar Council” (Membership # 12766) and district “Bar Association of Dhaka” (Membership # 11177) has been received death threats along with his family. On 7^th December 2012 around at 6.50 pm, he received threats for the life of his wife, mother and him over mobile phone, while he was staying at his home.

A general diary (GD) has been lodged in this connection with Mohammadpur police station under Dhaka metropolitan police (DMP) being general diary number 547, dated 7 December 2012 and Mr. Selim Reja, sub inspector (SI) of the said police station has been assigned for take action, but yet no initiative has been taken to take action against the allege perpetrator.

According to Mr. Islam, one unknown people asked Mr. Islam about his staying place at that moment using the mobile phone on Friday early of the night around at 6.50 pm and threatened him to kill being angry as fire, while Mr. Islam asked the perpetrator about his identity instead of disclosed Mr. Islam's staying place due to security reason. Latter, the alleged perpetrator again phoned him and uttered filthy language toward Mr. Islam. Furthermore, the perpetrator uttered filthy language about Mr. Islam’s mother and wife and later, he threatened Mr. Islam to kill his mother and wife. Meanwhile, the alleged perpetrator identified him as death of Mr. Islam and the said perpetrator assured that he will be appeared before Mr. Islam in due time. Finally, he switched off his phone after making caution that Mr. Islam will be suffered for the effect of his continuing activities immidiately.

Here specially mentions that during the time of his duties, Mr. Islam published many report on abusing law and human rights by the state agencies and state sponsored terrorist including powerful political, social and religious group. He also moved many cases against the perpetrators as a lawyer and some of them have been punished. He also conducted many investigations and fact-finding missions on human rights violations as well as issued local and international urgent appeals requesting attention to concerned authorities.

Mr. Islam received a lot of threats, death threats as well as faced physical attacked, arrest and harassment previously due to his activities on upholding human rights in Bangladesh.

Mr. Islam apprehends that he would be killed in any time and cordially asked to the national and international body for ensuring the security of him and his family.

Mrs. Kolpone, a 36 year-old woman and mother of a ten year-old girl, was arrested in July 2009 by the Paltan police station in Bangladesh, alleging that she had stolen two gold bangles along with some  money. Although the police were not able to recover any of the stolen goods, she was put into custody. Two and a half years passed and she was still in jail without a trial, as she was unable to appoint a lawyer.

In Feburary 2011, attorney Shahanur Islam, 2010 JusticeMakers Fellow from Bangladesh, took up Mrs. Kolpona’s defense and conducted an interview with her at the Dhaka prison center. One year later in April 2012, Shananur Islam and attorney Mohammad Alamgir, from JusticeMakers Bangladesh, appeared in the Metropolitan Magistrate Court of Dhaka and got her released from custody.

This is only one of the many cases that our 2010 JusticeMaker Fellow solved by providing direct support to the victims of human rights violations and injustices. Furthermore, by conducting a fact-finding investigation, he found out facts which helped to lobby the authorities by issuing urgent appeal, which was helpful in receiving justice.

During his project execution, he also ran training sessions to reduce torture and promote respect for human rights. Professionals from a variety of sectors attended these sessions: lawyers, police officers and prison officials, journalists, judicial officials and human rights activists. These people then joined the unofficial network of people around the world battling against torture and other human rights violation.

It wasn’t easy for Shananur Islam to implement his project. He faced a lot of challenges while doing his job: “I have received repeated threats, death threats, intimidation, arbitrary arrest, detention, ill treatment, physical assault and harassment by the law and security personnel and also from local pressure groups due to my activity and voice against torture,” claims our JusticeMakers Fellow.

The project period has since passed, and all the proposed activities have been completed in a timely fashion. “I think my participation was interactive and the victims who received direct support are pleased and grateful about our [IBJ's] support”, says Islam.

However, as a human rights defender, 2010 JusticeMakers Fellow Shahanur Islam is continuing his activities upholding human rights in Bangladesh. He is still working for the victims of torture and extrajudicial killing as well as victims of injustice who may be in prison due to financial inability, and people living in vulnerable conditions. The professionals trained during his JusticeMakers project are  assets to him, supporting him continuously by providing information and assisting additional people.

“The project is good enough, but for better results, we need to continue it in the long-term. We need to make a strong network in every district and build a core group of volunteers to help us conduct the training lessons, fact find, issue urgent appeals, and other activities”.

পুলিশের সহযোগীতায় মানবাধিকারকর্মীকে অপহরনপূর্বক হত্যা প্রচেষ্টা মামলা তদন্তে পুলিশের গড়িমসি!!!

 গত ০৭/০৬/২০১২ ইং তারিখ সময় আনুমানিক ৭.৩০ মিনিটের সময় ব্যাক্তিগত কাজে মানবাধিকার সংগঠন জাস্টিসমেকার্স বাংলাদেশের তথ্যানুসন্ধান সহযোগী গনেশ রাজবংশী ডিএমপি, ঢাকার হাজারীবাগ থানাধীন ট্যানারী মোড় এলাকার তুলা গাছতলার পার্শ্ববর্তী হেলাল ট্যানারির গলিতে উপস্থিত হলে ৪/৫ জন অপরিচিত ব্যাক্তি তাকে জাপটিয়ে ধরে নাকে মুখে ক্লোরোফর্ম যুক্ত ভেজা কাপর চেপে ধরে অজ্ঞান করে হাত-পা ও চোখ-মুখ বেঁধে অপহরণ করে ঢাকাস্থ হাজারীবাগ থানার মিতালী রোড সংলগ্ন “রোজ বিল্ডার্স” কর্তৃক ভবন নির্মাণের জন্য নির্ধারিত টিনে ঘেরা স্থানে নিয়ে যায়। সেখানে মিরপুর রিজার্ভ অফিস, ডিএমপি, এর সদস্য পুলিশ সদস্য রুমেন দে এবং রাজনৈতিক সন্ত্রাসী সুজন রায়, আকাশ শীল সহ ৫/৬জন অপরিচিত ব্যাক্তি তাকে লাঠি ও বোতল দিয়ে আমাকে এলোপাতাড়িভাবে বেধড়ক মারপিট করতে থাকে। এ সময় তারা বলতে থাকে যে, “শুয়ারের বাচ্ছা, মানবাধিকার কর্মী হইছস, শালার পাছা দিয়ে আজ মানবাধিকার ঢুকিয়ে দিব”। এসময় তারা আরও বলে যে, “এই হারামজাদাকে আজ শেষ করে দেই, এরপর এই শালার ওস্তাদ বালফালানা আইনজীবী ও জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব এডভোকেট শাহানূর ইসলামকে শেষ করে দিয়ে এদের মানবাধিকার করার সাধ আজীবনের জন্য বুঝিয়ে দিব”। এসময় মি। গনেশ জ্ঞান হারিয়ে ফেলে। কিছুক্ষণ পর তার জ্ঞান ফিরে আসলে বাঁচতে চাইলে তাকে দু’লক্ষ টাকা দিতে হবে, অন্যথায় তাকে হত্যা করার হুমকি প্রদান করে। মি। গনেশ সামান্য একজন মানবাধিকার কর্মী, এত টাকা তিনি কোথায় পাব তাই টাকা দিতে অস্বীকার করলে সন্ত্রাসীরা তাঁর গলা চেপে ধরে হত্যার চেষ্টা করে। এসময় তারা তাঁর মুখের ভিতর গামছা ঢুকাতে থাকে, একই সাথে দুই কান ও নাকের ভিতর বাঁশের শলাকা দিয়ে খোঁচাতে থাকে এবং দু’ চোখের ভিতর আংগুল দিয়ে চোখ তুলে নেওয়ার চেষ্টা করে । ফলে ফলে তাঁর নাক কান দিয়ে দর দর করে রক্ত বের হতে থাকে। এসময় তিনি আবারও অজ্ঞান হয়ে পড়ে। কিছুক্ষণ পর জ্ঞান ফিরলে সন্ত্রাসী গন তাঁর হাত পায়ের বাঁধন খুলে দিয়ে একটি চেয়ারে বসিয়ে হাত পিছন মোড়া করে চেয়ারের সাথে বেঁধে ফেলে। তারপর, তার সাথে মোবাইল ফোন সেট এবং নগদ ৫০০০/-(পাঁচ হাজার) টাকা ছিনিয়ে নেয়। অতঃপর, তারা মি। গনেশ আর কোন দিন মানবাধিকার সুরক্ষায় জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব এডভোকেট শাহানূর ইসলামের সাথে কাজ করবে না মর্মে অংগীকার করে ১ টি  ১০০/-(একশত) টাকা ও একটি ৫০/-(পঞাশ) টাকার অলিখিত নন-জুডিশিয়াল স্টাম্পে স্বাক্ষর দিতে বলে। কিন্তু তিনি স্বাক্ষর দিতে অস্বীকার করলে সন্ত্রাসীগন তার দুহাতের আঙ্গুল সেভেন আপের বোতল দিয়ে থেতলিয়ে দেয়। পরবর্তীতে, তারা জোর করে উল্লেখিত স্টাম্প দুটিতে তার ডান হাতের বৃদ্ধা আঙ্গুলের টিপ সই নেয়। অতপর, সন্ত্রাসী গন তাঁকে বস্তায় ভরে বুড়ি গংগায় ফেলে হত্যার উদ্দেশ্যে তাঁর হাত পায়ের বাঁধন খুলে দিয়ে অজ্ঞাতনামা ২ জন আসামী  রিকশায় করে তাকে বেরী বাঁধের দিকে নিতে থাকে। এ সময় রিক্সা হাজারীবাগ ট্যালী অফিস পানির পাম্পের নিকট আসলে মি। গনেশ সন্ত্রাসী দুজনকে ধাক্কা মেরে রিক্সা থেকে লাফ দিয়ে চিত্কার করতে থাকে। এসময় আব্দুস শহীদ, ডাঃ মৃত্যুঞ্জয় এবং টিপু আহমেদসহ অনেকে এগিয়ে এসে ৭/০৬/১২ ইং তারিখ দিবাগত রাত ১২.৩০ মিনিটে (০৮/০৬/১২ ইং তারিখ ভোর) তাকে উদ্ধার করে এবং ৮/০৬/১২ ইং তারিখ ভোর ২.৩০ মিনিটে স্যার সলিমুল্লাহ মেডিক্যাল কলেজ হাসপাতালের পুরুষ ওয়ার্ডের বি-১ শয্যায় ভর্তি করেন। ইতোমধ্যে বিষয়টি সম্পর্কে এডভোকেট শাহানূর ইসলামসহ অনেকে হাজারীবাগ থানার ভারপ্রাপ্ত কর্মকর্তাকে বিষয়টি অবগত করে দ্রুত ব্যবস্থা নেওয়ার আহবান জানান। কিন্তু হাজারীবাগ থানা পুলিশ দ্রুত ব্যবস্থা গ্রহন করবে বলেও কোন ব্যবস্থা গ্রহন করেন না। পরবর্তীতে মি। গনেশ হাসপাতালে ১২/০৬/১২ ইং তারিখ পর্যন্ত চিকিত্সাধীন থেকে একটু সুস্থ হলে হাসপাতাল কর্তৃপক্ষ রিলিজ প্রদান করলে তিনি সেদিনই থানায় গিয়ে মামলা দায়ের করতে চাইলে লিখিত এজাহারে পুলিশের নাম উল্লেখ থাকায় হাজারীবাগ থানা পুলিশ তা গ্রহনে অস্বীকার করে। পরবর্তীতে ১৩/০৬/১২ ইং তারিখ হাজারীবাগ থানা পুলিশ লিখিত এজাহারে পুলিশ সদস্যের পরিবর্তে “ ছোট ছোট চুল ওয়ালা একজন” বলে উল্লেখ করে উদ্দেশ্যমূলকভাবে সঠিক ধারায় মামালা নথিবদ্ধ না করে বাংলাদেশ দন্ডবিধির ৩২৩/৩২৫/৩৭৯/৩৮৬ ধারায় একটি মামলা নথিবদ্ধ করেন। যার হাজারীবাগ থানার মামলা নং- ১৪(০৬)/১২। কিন্তু অতীব দুঃখের বিষয় মামলা গ্রহন করলেও তা তদন্তে হাজারীবাগ থানা তত্পর নয়। এমনকি অভিযুক্ত পুলিশ সদস্য ও অন্যান্য চিহ্নিত রাজনৈতিক সন্ত্রাসীদের গ্রেফতার করত সঠিকভাবে নিরপেক্ষ তদন্ত সাপেক্ষে চার্জশীট প্রদানের কোন উদ্যোগ এখন পর্যন্ত পুলিশ গ্রহন করেননি।

 

Human rights defender and lawyer assult case: Police submits the destroyed report

Mr. Golam Mostofa Rashel, Senior Assistant Police Commissioner of Mohammadpur zone, DMP, Dhaka submitted a destroyed deport to the Metropolitan Magistrate Court on June 06, 2012 stating that the allegation made by Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh against  Mohammad Yusuf, sub inspector of Mohappadpur Police Station alleging attempt to arrest after physical attacked on April 03, 2012, while Mr. Islam visited the said police station to file a general diary asking to ensure the physical secuirity of him and his colleges, who were assist to file a case against jail superintend and jailor of Naogaon district as well as others seven police officials of Badalgachhi police station under Naogaon district, including the former officer in charge alleging death due to negligence after torture in police custody on March 19, 2012, resulting some unidentified people threatened Mr. Islam and his colleagues to with draw the said case on March 26 and April 03, 2012 respectively was not true.

Mr. Islam filed a petition case under section352 and 355 of penal code with the Chief Metropolitan Magistrate court on April 18, 2012 and the learned magistrate pleased to issue an order to the deputy commissioner of DMP (Tejgaon Zone) to submit the report by June 13, 2012 after proper investigation. Then Mr. Imam Hossain, deputy Police Commissioner, DMP (Tejgaon Zone) assigned to Mr. Golam Mostofa Rashel, Senior Assistant Police Commissioner of Mohammadpur zone, DMP, Dhaka to investigate the alleged incident.

Here especially mentioned that Mr. Golam Mostofa Rashel, investigating officer conducted his investigation sitting in his office Mohammadpur police station which is also the place of incident. During the investigation he created psychological pressure to Mr. Islam  to withdraw the case as well as Mr. Alamgir not to give the witness on behalf of Mr. Islam. Furthermore, one district Judge (Judge of Environment Court, Dhaka) level officer of Dhaka district and session judge court create influence to the eyewitness as well as Mr. Shahanur to withdraw the case. Moreover, while Mr. Alamgir only one eyewitness of the incident went to the Mohammadpur police station, DMP, Dhaka for giving his statement, the perpetrator Yusuf created a scaring environment always following him presenting that room where Mr. Alamgir was giving his statement. Finally, the investigation officer submitted destroyed report failing to manage Mr. Islam to withdraw the case.

থানায় মানবাধিকার কর্মী ও আইনজীবী লাঞ্ছনাঃ নির্যাতনকারী পুলিশ অফিসার যখন তদন্ত কমিটির সদস্য

বহুল আলোচিত ও নির্যাতনের অভিযোগে অভিযুক্ত পুলিশ অফিসার যখন থানা পুলিশ কর্তৃক মানবাধিকারকর্মী ও আইনজীবীকে শারীরিকভাবে লাঞ্ছনার অভিযোগে গঠিত তদন্ত কমিটির সদস্য হয়, তখন সেই তদন্তের ভবিষ্যৎ কি হবে তা সহজে অনুমানীয়। তদন্ত কমিটির সদস্য পুলিশ অফিসারটি আর কেউ নয়, জাতীয় সংসদের বিরোধীদলীয় চীফ হুইপ ও সংসদ সদস্য জয়নাল আবেদীন ফারুককে মানিক মিয়া এভিন্যুতে নির্মমভাবে নির্যাতন করে বহুল আলোচিত বর্তমানে ঢাকা মহানগর পুলিশের তেজগাঁও জোনে কর্মরত এডিসি বিপ্লব বিশ্বাস।


জাষ্টিসমেকার্স বাংলাদেশের প্রতিষ্ঠাতা মহাসচিব এবং বাংলাদেশ বার কাউন্সিল ও ঢাকা বার এসোসিয়েশনের সদস্য অ্যাডভোকেট শাহানূর ইসলাম পুলিশের বিরুদ্ধে সাধারণ ডায়েরী করতে চাওয়ায় মোহাম্মদপুর থানা ডিউটি অফিসারের কে এসআই মোহাম্মদ ইউসুফ কর্তৃক তাকে শারীরিকভাবে লাঞ্ছনাপূর্বক গ্রেফতারের চেষ্টার অভিযোগে জাতীয় মানবাধিকার কমিশন  কর্তৃক নির্দেশীত হয়ে স্বরাষ্ট্র মন্ত্রনালয় কর্তৃক গঠিত উচ্চ মতা সম্পন্ন তদন্ত কমিটির একজন সদস্য এই বহুল আলোচিত ও অভিযুক্ত নির্যাতনকারী পুলিশ অফিসার। তিন সদস্য বিশিষ্ট এ কমিটির অন্য দু’জন সদস্য হলেন স্বরাষ্ট্র মন্ত্রনালয়ের উপসচিব ( ইমিগ্রেশন এবং পাসপোর্ট) জনাব মো: সলিমুল্লাহ ও মানবাধিকার সংগঠন নাগরিক উদ্যোগের প্রধান নির্বাহী জনাব জাকির হোসেন। গত ২৪/০৬/২০১২ ইং তারিখে স্বরাষ্ট্র মন্ত্রনালয়ের সিনিয়র সহকারী সচিব মাকসুদা ইয়াসমিন এর স্বাক্ষরে গঠিত উক্ত কমিটিকে বিষয়টি যথাযথ তদন্তপূর্বক আগামী ২৪ জুলাই ২০১২ ইং তারিখের মধ্যে প্রতিবেদন দাখিলের নির্দেশক্রমে অনুরোধ করা হয়েছে। তারই ধারাবাহিকতায় কমিটি আজ অভিযোগকারী  অ্যাডভোকেট শাহানূর ইসলাম এবং অভিযুক্ত পুলিশ অফিসার এসআই মোহাম্মদ ইউসুফের বক্তব্য লিপিবদ্ধ করেন এবং আগামী ১৮ জুলাই ২০১২ ইং তারিখে সাক্ষীদের বক্তব্য গ্রহণের দিন ধার্য করেন।

পুলিশ কর্তৃক নারীর শ্লীলতাহানী এবং আইনজীবী ও সাংবাদিক নির্যাতনে জাস্টিসমেকার্স বাংলাদেশ উদ্বিগ্ন

আইন-শৃংখলা রক্ষাকারী বাহীনির হাতে ক্রমাগত মানবাধিকার লংঘনের ঘটনায় জাস্টিসমেকার্স বাংলাদেশ উদ্বিগ্ন। জাস্টিসমেকার্স বাংলাদেশ অত্যন্ত উদ্বেগের সাথে লক্ষ্য করছে যে, গত কিছুদিন যাবৎ আইন শৃংখলা রক্ষাকারী বাহীনি তাদের কাজকর্ম ও আচরনে বেপরোয়া ও আক্রমনাত্বক হয়ে উঠেছে। গত ২৬ তারিখে আগারগাঁও মহিলা পলিটেকনিক ইন্সটিটিউট এর সামনে পেশাগত দ্বায়িত্ব  পালন কালে পুলিশ কর্তৃক তিন ফটো সাংবাদিককে নির্যাতন করে। তাছাড়া, গতকাল ঢাকা মূখ্য মহানগর হাকিমের আদালতে বিচার প্রার্থী এক মহিলাকে আদালত সংলগ্ন পুলিশ ক্লাবে নিয়ে পুলিশের উর্দ্ধতন সদস্যের উপস্তিতিতে পুলিশ সদস্য তার শ্লীনতাহানী করে এবং সে ঘটনার সংবাদ সংগ্রহকারী সাংবাদিক ও প্রতিবাদকারী আইনজীবীদের শারীরিকভাবে নির্যাতন করে।

মানবাধিকার সংঘটন জাস্টিসমেকার্স বাংলাদেশ এর প্রতিষ্ঠাতা মহাসচিব অ্যাডভোকেট শাহানূর ইসলাম সৈকত উল্লেখিত মানবাধিকার লংঘনজনিত ঘটনায় অতীব উদ্বিগ এবং তীব্র ক্ষোভ পকাশ করছে। দেশের মানুষ সমস্যায় পড়লে  তাৎক্ষনিক সহযোগীতার জন্য যেখানে পুলিশের সাহায্যপ্রার্থী হন, সেই পুলিশ সদস্য যদি সাহায্য প্রার্থী নাগরিকের মানবাধিকার লংঘনের সাথে সরাসরি যুক্ত হয়, তবে দেশের মানুষের সার্বিক নিরাপত্তা হুমকির মুখে পরে। তাই সংঘটন জাস্টিসমেকার্স বাংলাদেশ উল্লেখিত ঘটনাগুলোর সুষ্ঠু ও নিপেক্ষ তদন্তের মাধ্যমে দায়ী পুলিশ সদস্যদের বিরুদ্ধে ব্যবস্থা নেওয়ার জন্য প্রধানমন্ত্রীর নিকট জোড় দাবী জানাচ্ছে।

তাছাড়া, জাস্টিসমেকার্স বাংলাদেশ সাংবাদিকদের পুলিশ থেকে নিরাপদ নিরাপদ দুরুত্বে অবস্থান করে সংবাদ সংগ্রহের পরামর্শ দেওয়া সংক্রান্ত  স্বরাষ্ট্র প্রতিমন্ত্রীর বক্তব্যের তীব্র নিন্দা জানাচ্ছে। জাস্টিসমেকার্স বাংলাদেশ স্বরাষ্ট্র প্রতিমন্ত্রীর মত সরকারের একজন গুরুত্বপূর্ন ব্যক্তির এরূপ দায়িত্বহীন বক্তব্যর পুলিশ বাহীনির কর্মকান্ড ও অচরন তাদের বেপরোয়া কর্মকান্ডকে উৎসাহিত করবে। পুলিশ আইনের প্রতি শ্রদ্ধাশীল হয়ে কাদের দায়িত্ব ও কর্তব্য পালনে জনবান্ধব হিসেবে কাজ করবে-এটিই জাস্টিসমেকার্স বাংলাদেশ প্রত্যাশা করে।

NHRC issues ordered to investigate the incident of physical attacked on human rights lawyer in police custody.

National Human Rights Commission (NHRC) of Bangladesh has been issued an order to investigate the incident of physical assault on Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh and also member of DhaKa Bar Association and Bangladesh Bar Council by the police official in Mohammadpur police custody under Dhaka metropolitan police.

NHRC asked to the senior secretary of home ministry to submit the report after proper investigation forming a three member’s enquiry committee comprising a at least a deputy secretary of home ministry, a high level police official and a representative from human rights non government organization nominated by the aggressive party.  

The ordered was issued under sign of Mrs. Shamim Ahammad, director with endorsement of Mr. Kazi Riyajul Haque, full-time member of National Human Rights Commission on April 24, 2012.

According to complaint, Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh and also member of Bangladesh Bar Council and Dhaka Bar Association received numerous threats for life from different unknown person through mobile phone to withdraw the case filed against nine prison and police officials including jail superintendent of Naogaon district prison centre and officer in charge of Badalgachhi police station with the learned judicial magistrate court in Naogaon district alleging to take bribe, torture in police custody and death due to negligence.

On April 03, 2012 around at 7.30 pm Mr. Islam along with Advocate Mohammd Alamgir, founding vice chairman of JusticeMakers Bangladesh and also member of Bangladesh Bar Council and Dhaka Bar Association went to the Mohammadpur police station under Dhaka Metropolitan Police (DMP) to file a general diary to ensure his physical security.

Mr. Islam submitted a written application to the duty officer of Mohammadpur police station Mr. Yusuf and requested him to register a general diary stating about his current threats. But, the duty office threw the paper to opposite side of his table mentioning that he would not register any general diary regarding connecting to the police. Then, Mr. Islam requested him again to read the whole statement carefully and again asked him registered the general diary politely. Later, Mr. Islam submitted an oral allegation Officer in Charge (OC) of Mohammadpur police station against the SI Md. Yusuf demanding his proper punishment. But the OC did not take any action against the perpetrator. Rather he tried to compromise the matter being apologized on behalf of the sub inspector confessing about the involvement of such heinous incident in presence of Mohd Jahangir Alam, adviser of JusticeMakers Bangladeshand also chief of crime division, united news of Bangladesh (UNB).

On April 04, 2012 Mr. Islam filed a complaint to the National Human Rights Commission demanding the exemplary punishment of the perpetrator who was directly and indirectly involved with this violalation of human rights as well as ensure his physical & psychological integrity.

Sued against Sub Inspector of Police alleging to physically attacked on Lawyer and Human Rights Defender at Police Station in Bangladesh

JusticeMakers Bangladesh has been sued against a sub inspector of police alleging to physically attack on a human rights defender and lawyer inBangladesh while he went to police station to register a general diary appealing to ensure his and his team members physical security.

Advocate Shahanur Islam founding general secretary of Justice Makers Bangladesh and also a member of Dhaka Bar Association and Bangladesh Bar Council filed the complaint case against Mohammad Yusuf, sub Inspector (SI) of police working at Mohammadpur Police station under 352 and 355 section of penal code with the Chief Metropolitan Magistrate (CMM) Court, Dhaka on April18, 2012.

The learned Metropolitan Magistrate-7 of Chief Metropolitan Magistrate Court, Dhaka Mr. Ismail Hossain has been taken the statement of the complainant Mr. Islam and pleased to issue an order to the Deputy Commissioner (DC) of police, Tejgaon Zone under Dhaka Metropolitan Police (DMP) to submit the investigative report by 13 June 2012 after proper investigation.

Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh and also member of Bangladesh Bar Council and Dhaka Bar Association received numerous threats for life from different unknown person through mobile phone to withdraw the case filed against nine prison and police officials including jail superintendent of Naogaon district prison centre and officer in charge of Badalgachhi police station with the learned judicial magistrate court in Naogaon district alleging to take bribe, torture in police custody and death due to negligence.

On April 03, 2012 around at 7.30 pm Mr. Islam along with Advocate Mohammd Alamgir, founding vice chairman of JusticeMakers Bangladesh and also member of Bangladesh Bar Council and Dhaka Bar Association went to the Mohammadpur police station under Dhaka Metropolitan Police (DMP) to file a general diary to ensure his physical security.

Mr. Islam submitted a written application to the duty officer of Mohammadpur police station Mr. Yusuf and requested him to register a general diary stating about his current threats. But, the duty office threw the paper to opposite side of his table mentioning that he would not register any general diary regarding connecting to the police. Then, Mr. Islam requested him again to read the whole statement carefully and again asked him registered the general diary politely. JusticeMakers Bangladesh assists a woman victim to get release from jail custody.

Kollpona, 36 years old woman mother of a ten year’s old daughter who had been arrested in July 2009 by the Paltan police station under Dhaka Metropolitan police from house of her master alleging to steal two gold bangles along with some cash money. Though the police was not able to recover any stolen goods, she was put to the jail custody. Then, around two and half years passed, she was in jail custody without trial being unable to appoint a lawyer.

JusticeMakers Bangladesh came to know about the incident in this year and took initiative to release her from the jail custody. On February, 2011, Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh took up Mrs. Kolpona’s defence and conducted interview with her at Dhaka prison centre.

 

Then, on April 03, 2012, Advocate Shahanur Islam and Advocate Mohammad Alamgir from JusticeMakersBangladesh appeared to Metropalitan Magistrate Court, Dhaka for bail on Mrs. Kolpona’s behalf and finally she got release from the jail custody.

Human rights advocate has physically been attacked at Mohammadpur police station

Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh and also member of Bangladesh Bar Council and Dhaka Bar Association has tried to been arrest after physically harassment at Mohammadpur police station under Dhaka Metropolitan Police (DMP) by the then duty officer and sub inspector Mr. Yusuf on April 03, 2012 while Mr. Islam went to the said police station for registering a general diary (GD) regarding threats received by him to withdraw the case filed with the learned judicial magistrate court in Naogaon district against nine prison and police officials alleging to take bribe and death due to negligence after torture at police custody.

Then, Mr. Islam submited a written statement to the duty officer Mr. Yusuf for register a general diary describing about his current threats. But the duty office threw the paper opposite side of his table mentioning he would not register any general diary regarding taking bribe, torture and death due to negligence. Then, Mr. Islam requested him to again read the whole statement carefully. At this stage Mr. Yusuf calling to Mr. Islam “beyadop” became angry as fire again rejecting to register the general diary. Then Mr. Islam asked him to give written statement for rejection to register the GD. Suddenly Mr. Yusub being violent jumped one side of his table from his chair and grabbed the color of the shirt of Mr. Islam and tried to put him in too the lock up of the said police station. In this time Advocate Mohammad Alamgir managed the duty officer not not put Mr. Islam in to the lock up humbly requesting him. Then the duty officer register the general diary being Mohammadpur police station GD number 261 dated 03.04.12 and  assigned to Sub inspector Afjal Hossain to investigate the incident of general diary.

Later, Officer in Charge (OC) of Mohammadpur police station confessed about the involvement of such heinous incident by the duty officer and apologized on behalf of the alleged police officer in presence of Mohd Jahangir Alam, adviser of JusticeMakers Bangladesh and also chief of crime division, united news of Bangladesh (UNB).

JusticeMakers Bangladesh deeply concerned over physical harassment of Mr. Islam by the police official of Mohammadpur police station and demanded prompt action against the alleged perpetrators after a judicial enquiry as well as ensures the adequate physical integrity of Mr. Shahanur Islam and JusticeMakers team.

ঘটনায় প্রকাশ, গতকাল ০৩ এপ্রিল ২০১২ ইং তারিখ আনুমানিক রাত ৭.৩০ ঘটিকার সময় এডভোকেট শাহানুর ইসলাম ও এডভোকেট মোহাম্মদ আলমগীর একটি সাধারন ডায়েরী (জি ডি) নথিভুক্ত করার জন্য ঢাকা মহানগর পুলিশ এর মোহাম্মদপুর থানায় যান। সেখানে কর্তব্যরত ডিউটি অফিসার সাব ইন্সপেক্টর ইউসুফকে লিখিতভাবে বিষয়টি প্রদান করে তা জিডি হিসেবে নথিভুক্ত করার অনুরোধ করলে তিনি সম্পুর্ন বিষয়টি না পড়ে পুলিশ কর্তৃক ঘুষ গ্রহন, নির্যাতন ও নির্যাতন পরবর্তী অবহেলায় মৃর্ত্যুর বিষয়ে কোন সাধারন ডায়েরী নথিভুক্ত করতে পারবেন না বলে লিখিত কাগজটি টেবিলে অপর পাশে ছুড়ে ফেলেন। এসময় এডভোকেট শাহানুর তাঁকে আবারো বিষয়টি ভালভাবে পড়ার অনুরোধ করলে তিনি রাগান্বিত হয়ে এডভোকেট শাহানুরকে বেয়াদপ বলে চলে যেতে বলেন। তখন এডভোকেট শাহানুর জিডি টি নথিভুক্ত করতে পারবেন না মর্মে লিখিত দিতে অনুরোধ করলে তিনি তার চেয়ার থেকে লাফিয়ে উঠে টেবিলের সাইডে এসে এডভোকেট শাহানুরের জামার কলার ধরে তাকে টানতে টানতে লকাপে ঢুকানোর চেষ্টা করেন। এসময় এসময় ঘটনাস্থলে উপস্থিত এডভোকেট মোহাম্মদ আলমগীর তাঁকে ছেড়ে দেওয়ার অনুরোধ করলে কিছুক্ষন পর তাঁকে ছেড়ে দেন এবং পরবর্তীতে মোহাম্মদপুর থানার সাধারন ডায়েরী নং ২৬১ তাং- ০৩/০৪/২০১২ নথিভুক্ত করে এস আই আফজাল হোসেনকে তদন্তভার অর্পন করেন। এ বিষয়ে প্রতিকার চেয়ে এডভোকেট শাহানুর ইসলাম জাতীয় মানবাধিকার কমিশন ও ঢাকা বার এসোশিয়েশন বরাবর পৃথক দুটি আবেদন করেছেন।

বিষয়টি মানবাধিকারের লংঘন ও একজন আইনজীবী ও মানবাধিকার কর্মীর পেশাগত স্বাধীনতার প্রতি হুমকিস্বরুপ এবং অভিযুক্ত পুলিশ অফিসার কোনভাবে দায় এড়িয়ে যেতে পারে না বলে জাস্টিসমেকার্স বাংলাদেশ মনে করেন। জাস্টিসমেকার্স বাংলাদেশ ঘটনাটির নিরপেক্ষ বিচার বিভাগীয় তদন্তের মাধ্যমে অভিযুক্ত পুলিশ কর্মকর্তার বিরুদ্ধে অবিলম্বে যথাযথ ব্যবস্থা নেওয়ার জোড় দাবী জানাচ্ছে।

A petition case being has been filed on March 21, 2012 against nine (9) police and prison officials including Jail Superintendent & Jailor of Naogaon district jail as well as former Officer in Charge (OC) and present second officer of Badalgachhi police Station under Naogaon district with the Judicial Magistrate Court, Naogaon under section 161/ 164/323/324/304 (KA) 34/506 alleging to take bribe, torture in custody and death due to negligence. The case has been filed by Mrs. Afroza Begum, wife of the victim Abdul Bari Dulu of village South Kanda (Mistripara) in Badalgachhi Police Station under Naogaon district with direct support of the human rights organization JusticeMakers Bangladesh.

The accused were identified as Anwaruzzaman, Jail Superintendent; Faruk Ahmed, Jailer of Naogoan district jail;  Mahfuzul Haque, former Officer in Charge (OC) of Badalgachhi Police Station; District Jail Pharmacist Jahed Nurul Islam; Rafiqul Islam, Sub Inspector;  Touhidul Alam, Sub Inspector;  Karibul Hasan, Sub Inspector; Rabiul Islam, Assistant sub Inspector and  Abdul Razzak, constable of Badalgachhi police station under naogaon district.

The learned No-5 Naogaon Judicial Magistrate Court of Cognizance registered the case being number C.R 34(Badal)/2012. Later, the learned Judicial Magistrate of Mr. Abu Based Mohammad Bulu Miah recorded the statement of the complainant Mrs. Afroza Begum, wife of the victim and pleased to pass an order to submit the report about whether any unnatural death (UD) case had been registered or not previously to the Sodar police station of Naogaon district regarding the death of the victim by May 13, 2012.

According to complaint, the victim Abdul Barik Dulu and the wife of the victim as well as  the complainant of this case Mrs. Afroza Begum had gradually been compelled to give a lot of bribe to the police officer of Badalgachhi police station for not arresting the victim as well as not attaching the goods of their home in connection of an order passed by the Chief Metropolitan Magistrate Court connecting a fraud case filed with the Shahbag police station in Dhaka Metropolitan Police. Continuance of it, Mr. Rabiul Islam, Sub Inspector of Badalgachhi police station demanded 20,000/= BDT for not arresting the victim on December 16, 2011 as well as not attaching the goods of their house. Furthermore, he demanded more 50,000/= Taka for not arresting the victim ad also not attaching the goods of their home by next two months. According to his demand the complainant provided BDT 5000/-  to the accused sub inspector through Mr. Abdul Jalil, Member of Mithapur Union Parishad on December 18, 2011 and also promised to give more 20,000/=BDT by December 28, 2011.

Meanwhile, Touhidul Alam, sub inspector of Badalgachhi police station arrested the victim on December 20, 2011 morning and tortured in Badalgachhi police station using electric shock, kicking with boot, slapping, beating with baton on toe for whole night. Later, the victim was laid down at floor of the police custody while his physical condition was deteriorated feeding oral saline.

Getting news of the deteriorating condition of the victim on December 21, 2011 morning, the wife of the victim went to the police station where Karibul Hasan, sub inspector of the said police station asked her to give BDT 20,0000/= for the proper treatment of the victim. But the wife of the victim failed to meet up his demand due to unavailability of demeaned money. Then two police constables took the victim to the out door of Badlagachhi Upazila Health Complex and moved forward to Naogaon district Magitrate Court after primarity treatment. Then, the victim was handed over the court police of Naogaon district Judicial Magistrate court where the victim was laid down on the bench in to the court custody.

There after the victim was appeared to the Judicial Magistrate of Naogaon district with the help of court police and the learned magistrate pleased to pass an order to send him to jail custody with proper treatment onDecember 21, 2011. But the authority of Naogaon district jail failed to give adequate treatment of the victim providing eye washing treatment by a jail pharmacist. On night of the same date the physical condition of the victim was deteriorated, but the jail authority did not take any initiative to admit him immediately to a hospital with adequate medical facilities out side of the jailon that night, rather he was admitted to Naogaon general hospital on the following day December 22. 2011 morning, kept in bar fetters (danda beri) and hand cuff fastened with bed by thick rope with unhygienic environment.

Being informed about the deteriorating condition of the victim, the wife of the victim rushed the hospital around atnoon and tried to be touch of the unconscious victim for clearing his cloth that was dirty with stool and urine left by the victim. But the jail police did not allow her to be touch with the victim, rather gave advice to bring permission from the jail authority. Finally around at 7.15 pm the victim was dead due to negligence of treatment and some unknown person came and open the bar fetters (danda beri) and hand cuff and escaped immediately.

A high level fact finding mission of Justice makers Bangladesh comprising three members, led by Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh had been conducted regarding the incident of this gross violation of human rights visiting the spot, taking statement of the witness, alleged perpetrators and concerned authorities. During the fact finding investigation, the Second officer of Badalgachhi police station confessed about taking bribe from the victim and proudly announced that they were entitled to take illegal money from accused person for the cost of fuel, tea and cigarette and also threatened to Mr. Shahanur Islam, chief of the fact finding team not to move forward about that matter in future. Furthermore, he made alert to Mr. Islam stating if Mr. Islam would not stop his activities connecting the incident gross violation, he would face more problems in future.

As Mrs. Afroza Begum, wife of the victim was a poor man with no ability to bear cost regarding legal battle to get justice bringing the perpetrators before the book, she sued the case with the direct assistant of human rights organization JusticeMakers Bangladesh.

Advocate Shahanur Islam, founding secretary general of JusticeMakers Bangladesh and Advocate Ashik Al Imran Hillol moved the case on behalf the complainant.
